CONTEST RULES

ATLAS VAN LINES (CANADA) LTD., LOCATED AT 485 NORTH SERVICE RD. E, OAKVILLE, ON L6H 1A5, CANADA (THE “CONTEST SPONSOR”) IS ADMINISTERING A CONTEST AND PRIZE GIVEAWAY (THE “CONTEST”) FOR THE SUMMER OF 2024 (THE CONTEST PERIOD IS DEFINED BELOW). THESE RULES ARE THE STANDARD TERMS AND CONDITIONS APPLICABLE TO THE CONTEST. THE CONTEST IS INTENDED TO BE CONDUCTED IN ALL PROVINCES AND TERRITORIES OF CANADA AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO ALL APPLICABLE FEDERAL, PROVINCIAL AND MUNICIPAL LAWS IN CANADA. NO PURCHASE IS NECESSARY. VOID IN WHOLE OR PART WHERE PROHIBITED BY LAW. ENTRY IN A CONTEST CONSTITUTES ACCEPTANCE OF THESE CONTEST RULES (THE “CONTEST RULES”).

 

 

Book with Atlas Van Lines Canada by September 15th for a chance to win 1 of 5 Weber Grills. Enjoy a new Weber Genesis BBQ (value of $899). If the Weber Genesis BBQ is out of stock or otherwise unavailable at the time of awarding, the winner will be compensated with a prize of equal value. The replacement prize will be selected based on availability and may differ in brand, model, and features. The decision regarding the replacement prize will be final and at the sole discretion of the contest organizers.

 

 

HOW TO PARTICIPATE

 

  1. Eligibility: To be eligible to participate in the Contest, the entrant (“Entrant”) must: (i) be a legal resident of Canada; and (ii) have reached the age of majority in the province or territory in which they reside as of the first day of the Contest Period (defined below).
  2. Non-Eligibility: The Contest is not open to the officers, directors, shareholders, employees, agents or representatives of: (i) the Contest Sponsor (including, without limitation, its respective divisions, affiliates, subsidiaries and/or related companies); (ii) the Contest Sponsor’s advertising or promotional agencies; or (iii) any supplier providing a Prize (defined below) or other materials or services in connection with the Contest (collectively, the “Excluded Individuals”), all of whom shall be specifically ineligible to participate in the Contest. The Contest is also not open to the immediate family (defined as parents, children, siblings and/or spouse) of the Excluded Individuals or any other persons with whom the Excluded Individuals reside, all of whom shall be specifically ineligible to participate in the Contest. 
  3. Verification: The Contest Sponsor shall have the right at any time to require proof of identity and/or proof of eligibility to participate in the Contest. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied to the Contest Sponsor for the purpose of the Contest must be truthful, complete, accurate and in no way misleading. The Contest Sponsor reserves the right, in its sole discretion, to disqualify any Entrant should such an Entrant at any stage supply information that does not meet these requirements.
  4. Contest Period: The entry period for the Contest (the “Contest Period”) shall be from 12:01 AM Eastern Standard Time (“EST”) on June 24, 2024 until midnight EST on September 15, 2024. All entries must be received during the Contest Period. 
  5. Participation: To enter the Contest, an Entrant must do the following prior to the end of the Contest Period: (i) request a quote and book a move using the contest landing page at https://www.atlasvanlines.ca/move-with-atlas-win-a-weber-grill/ (the “Landing Page”), or (ii) mail an entry to the Contest Sponsor as indicated in Section 1.6 of these Contest Rules. Entrants who choose to forego booking a move utilizing the Landing Page stand the same chance of winning a Prize as those who book such a move. NEITHER METHOD OF ENTRY WILL INCREASE OR DIMINISH, OR OTHERWISE IMPACT, AN ENTRANT’S CHANCES OF WINNING THE CONTEST. ODDS OF WINNING ONE OF THE PRIZES DEPEND UPON THE TOTAL NUMBER OF ELIGIBLE ENTRIES RECEIVED DURING THE CONTEST PERIOD. Upon requesting a quote and booking a move using the Landing Page or mailing an entry (in accordance with Section 1.6 of these Contest Rules), an eligible Entrant will be entered into the Contest for one (1) chance to win a Prize. 
  6. No Purchase Necessary: There is no purchase necessary to enter the Contest. To enter without booking a move, an Entrant may hand-print their name, address, postal code, email address and phone number on a plain piece of paper with the title “Weber BBQ Giveaway” and sign it. Place the entry form in an envelope and mail it with sufficient postage to Atlas Van Lines (Canada) Ltd., ATTN: Jackie McCulloch, 485 North Service Rd. E, Oakville, ON L6H 1A5, Canada. Entries must be postmarked and received by the last day of the Contest Period to be eligible. Limit of one (1) entry per envelope with sufficient postage. All mail-in entries will bear the same odds as entries for booked moves.
  7. Contest Entry Restrictions: Entrants are restricted to one (1) entry (via booking a move or mail-in entry without purchase) per person, for the Contest Period. Any excess entries will be invalid for purposes of the Contest draw.

PRIZES

 

  1. Five Available Prizes for the Contest Period: There are five (5) prizes available to be awarded to a Prize winner (a “Winner”) for the Contest Period, with each prize consisting of one (1) Weber BBQ with an approximate retail value of CAD $899 (each, a “Prize”). There will be five (5) Winners selected, with each Winner receiving one Prize. 
  2. Prize Draws: Each Prize will be awarded by a random draw utilizing www.random.org (or another similar website in the event www.random.org is unavailable for use) from all eligible entries received during the Contest Period. The draws for the five Winners will occur on September 16, 2024, before 5:00 p.m. EST in Oakville, Ontario. 
  3. Odds: The odds of winning each Prize depend upon the total number of eligible entries received during the applicable Contest Period. 
  4. Notification of Selection: The selected Entrants will be notified by telephone, email and/or mail. If a selected Entrant cannot be contacted within fourteen (14) days of the draw being completed, such selected Entrant shall be disqualified and, in that case, an alternative eligible Entrant will be selected by way of a further random draw from the eligible entries received. 

 

Before being declared a Winner for the Contest Period, the selected Entrant must, within seven (7) days after being notified of selection: (i) correctly answer, unaided, a time-limited, mathematical skill-testing question to be administered by telephone; and (ii) complete and sign a standard declaration, release and indemnity form, in a form prepared by the Contest Sponsor or its legal counsel, confirming compliance with the Contest Rules; confirming acceptance of the Prize, as awarded; and releasing the Contest Sponsor and its advertising and promotional agencies, as well as their respective parents, subsidiaries, affiliates and related companies, and their respective officers, directors, shareholders, employees, representatives and agents (collectively the “Contest Sponsor Group”) from any and all claims, actions, losses, liabilities, damages, costs and expenses (collectively “Claims”) resulting from the Contest and/or the awarding of and/or use of the Prize. If the selected Entrant fails to comply with these conditions within the aforesaid seven (7) day period, they shall be disqualified, and another eligible Entrant will be selected by way of a further random draw. If requested, the selected Entrant shall provide valid identification at the time they are awarded the Prize. 

 

  1. Prize Acceptance: Each Prize must be accepted as awarded. If it is not accepted as awarded, then the selected Entrant for that Prize shall forfeit the Prize and the Contest Sponsor Group shall be automatically released of any and all obligations to the selected Entrant with respect to the applicable Contest and/or the Prize. A Prize cannot be transferred, assigned, exchanged, or substituted by a selected Entrant and is not convertible to cash. The Contest Sponsor reserves the right to substitute each Prize or any Prize component with another prize of comparable or greater value. The Contest Sponsor will not be required to award more prizes than what is provided for in these Contest Rules or to award a prize other than in accordance with these Contest Rules.
  2. Declaration: Only the persons declared by the Contest Sponsor to be the Winners of the Contest will be entitled to a Prize, subject to each selected Entrant’s eligibility for the Contest and compliance with these Contest Rules. For the Contest Period, the Prizes will be sent to the Winners promptly after each Entrant has satisfied all conditions in these Contest Rules and been declared to be a Winner.
  3. Taxes: Taxes and any other costs or expenses relating to the Contest and each Prize awarded (if any) are the sole responsibility of each Winner of the Contest. 

ENTRIES 

 

  1. Entries: All entries become the property of, and are subject to verification by the Contest Sponsor and none will be acknowledged or returned. Any entry that is illegible, incomplete, altered or contains false information is invalid. All Entrants consent and agree, without compensation, to the use of their name and likeness in any related advertising or publicity by the Contest Sponsor and its affiliated and related companies and representatives. The Winner of each Prize authorizes the Contest Sponsor Group to broadcast, publish and disseminate their name, photographs, likeness and voice in connection with any promotion or publicity, and/or for general news and information purposes at no compensation to the Winner. 
  2. Personal Information: Personal information collected from Entrants will be used only for administering the Contest, including but not limited to contacting and/or announcing the Winner of each Prize and coordinating the provision of the Prizes. By participating in the Contest, each Entrant acknowledges that the Contest Sponsor may disclose such personal information to third-party agents and service providers of the Contest Sponsor in connection with Contest-related activities.

OTHER CONTEST RULES

 

  1. Claiming a Prize: Claiming a Prize is subject to verification by the Contest Sponsor. Entries made with multiple addresses or identities or through the use of any device or artifice to enter multiple times or entries during the Contest Period are automatically void. Further, all entries that are incomplete, illegible, mutilated, altered, reproduced, forged, irregular or fraudulent in any way or otherwise not in compliance with these Contest Rules are automatically void. 
  2. Contest Sponsor Decisions: The decisions of the Contest Sponsor are final, and Entrants agree to abide by all of the instructions and decisions of the Contest Sponsor. In the event of any disagreement as to whether a person is eligible to participate in the Contest, or as to the qualifications of a selected Entrant, the decision of the Contest Sponsor shall be final. All decisions with respect to all matters relating to the Contest shall be made by the Contest Sponsor or its representatives and any such decisions shall be final and binding in all respects and there shall be no rights of appeal with respect to any such decision or the Contest. Entrants may be disqualified if they do not comply with the Contest Rules.
  3. Reservation of Rights: The Contest Sponsor reserves the right, at its sole discretion and without prior notice, to amend, cancel, terminate, close, suspend or reinstate the Contest at any time and for any reason whatsoever including, without limitation, in order to comply with any applicable law or policy or in the event that the Contest is not capable of being conducted as originally planned, or if fraud or any other occurrence compromises the fairness or integrity of the Contest. If for any reason the Contest is not capable of being completed as planned including, but not limited to computer virus, bugs, tampering, technical failures or other causes beyond the control of any of the Contest Sponsor Group, the Contest Sponsor reserves the right to cancel, suspend or modify the Contest.
  4. Prohibited Acts: Any attempt to tamper with the entry process, interfere with the Contest, deliberately damage any website or undermine the administration, security or legitimate operation of the Contest (collectively referred to as “Prohibited Acts”) is a violation of law and the Contest Sponsor reserves the right to seek damages and/or other relief from all persons responsible for such Prohibited Acts to the fullest extent permitted by law, which may include banning or disqualifying Entrants from the Contest and any future contests, and any such persons may be disqualified from and will forfeit any Prize(s) awarded. 
  5. Void Where Prohibited: The Contest is void where prohibited. The Contest Sponsor does not warrant that the Contest may be entered into legally in any particular jurisdiction.
  6. Notices regarding Liability: The Contest Sponsor assumes no responsibility for entries that are: lost, stolen, delayed, damaged, altered, misidentified or misdirected, or for the failure, interruption, technical malfunction or delay of any online account or email or other communication to be received, for any reason; any incorrect or inaccurate information, whether caused, without limitation, by the Contest website users or by any equipment or programming associated with or utilized in the Contest by any technical or human error or malfunctions which may occur in the processing of entries in the Contest; printing errors; altered or garbled data or transmissions, problems with the function of any website or website feature howsoever caused; the malfunction of, or damage caused to, any telephone network or lines, computer equipment, data or software, email, online systems, servers or access providers, players or browsers; any functionality lost due to not having cookies enabled; traffic congestion on the Internet; the security or privacy of information transmitted via computer networks; or for breaches of privacy due to interference by third party computer “hackers”. Entry materials/data that have been tampered with or altered are void. 

 

Further, in no event or circumstance shall any of the Contest Sponsor Group be responsible for any accident, damage to property, injury or death which may arise from participating in the Contest or a Winner’s use or receipt of a Prize. Each Entrant hereby acknowledges and agrees that the Contest Sponsor Group shall not be responsible for nor bear any liability for the loss, theft or misuse of a Prize. The Contest Sponsor Group shall not be liable for any loss or damage caused directly or indirectly by technical difficulties or errors, negligence or problems in the administration of the Contest or acts of God or any other matter outside of their control which may affect the conduct of the Contest. 

 

  1. Release: By entering the Contest, each Entrant agrees to abide by these Contest Rules, which are subject to change without notice, and each Entrant releases the Contest Sponsor Group from any and all Claims directly or indirectly suffered as a result of or arising from the Entrant’s participation in the Contest. 
  2. Language Discrepancy: In the event of any discrepancy or inconsistency between these Contest Rules and disclosures or other statements contained in any Contest-related materials, including but not limited to print or online advertising, the terms and conditions of the Contest Rules shall prevail, govern and control.
  3. Social Media: The Contest is in no way sponsored, endorsed or administered by any social media platforms on which the Contest may have been promoted and/or publicized. Any questions or comments regarding the Contest must be directed to the Contest Sponsor and not to any of the social media platforms on which the Contest may have been advertised or administered.
  4. Law: This Contest is governed by and shall be interpreted in accordance with the laws of the Province of Ontario and the federal, provincial and municipal laws of Canada applicable therein.
